Stock can be limited, especially for tour and special collections. We may cancel orders and restrict access where we believe these rules have been broken; where we cancel a genuine customer's order we will refund it in full promptly.
A6.Intellectual property
The sites and their content are owned by us, our licensors and the artist. The artist's names, logos, artwork and trade marks are protected and may not be used without permission. A10.Governing law (website use)
| United Kingdom | European Union / EEA |
|---|---|
| These Website Terms of Use are governed by English law, and the English courts have jurisdiction. As a consumer you keep the benefit of any mandatory protections of the country where you live. | These Website Terms of Use are governed by German law. As a consumer you keep the benefit of any mandatory protections of the EU/EEA country where you live. |
B1.The products and these terms
These Terms of Sale govern the sale of goods through our stores. The entity you contract with is set out in the table above. All goods are 100% officially licensed; product images and descriptions are for guidance and slight variations may occur, and we may correct genuine errors in descriptions or prices. You must be at least 18 years old (or the age of majority where you live) and have the legal capacity to enter into a contract to place an order.
B2.How the contract is formed
Before you place your order, the checkout allows you to review your order and correct any input errors. Your order is an offer to buy. A contract is formed only when we send you a dispatch confirmation by email (which we provide on a durable medium), not when you place the order or receive an acknowledgement. If we cannot accept your order (for example an item is out of stock, or there has been a manifest pricing error that a reasonable customer would notice) we will tell you and will not charge you, or will refund you in full.
B3.Price and payment
Displayed prices include VAT and the price is the price shown at checkout on the date of your order. Any charge you must unavoidably pay is included in the total shown before you place your order; delivery options and charges are shown before you pay. We accept Shop Pay, major credit and debit cards, Apple Pay and Google Pay (processed via Shopify Payments) and PayPal; in the EU we also accept local methods including Bancontact, EPS and iDEAL. The methods available are shown at checkout. If we discover a genuine and obvious pricing error we may cancel the order before dispatch and refund you.
B4.Delivery
We deliver worldwide. Estimated delivery times are shown at checkout and are indicative, not guaranteed, and risk passes to you on delivery. Depending on the destination you may be responsible for import duties and taxes; for orders into the EU we operate the Import One Stop Shop (IOSS no. IM3720021202) so import VAT is collected at checkout where applicable.
B5.Your right to cancel
| United Kingdom | European Union / EEA |
|---|---|
| Under the Consumer Contracts Regulations 2013 you may cancel within 14 days, without reason. The period runs from the day after you receive the goods, or the last item where the order is delivered in parts. Tell us before it ends (you may use the form at the end), then return the goods within 14 days; you are responsible for the cost of returning them. We refund within 14 days of receiving the goods back (or proof of return), including the standard outbound delivery cost. You may handle the goods only as you would in a shop; we may reduce your refund for any loss in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning. | Under the Consumer Rights Directive you have 14 days to withdraw, without reason, running from the day you (or a third party you nominate) receive the goods, or the last item where the order is delivered in parts. Inform us by a clear statement (you may use the model withdrawal form at the end) before the period ends, then return the goods within 14 days; you bear the direct cost of returning them. We reimburse within 14 days, including standard delivery, and may withhold reimbursement until we receive the goods back or proof of return. |
B6.When the right to cancel does not apply
This right does not apply to personalised or custom-made items, or to sealed audio or video recordings or software once unsealed. This does not affect your rights if goods are faulty.
B7.Faulty goods and your legal rights
| United Kingdom | European Union / EEA |
|---|---|
| Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. If they are not, you have a 30-day right to reject for a full refund, and after that may be entitled to repair, replacement, or a price reduction or refund. We pay return costs for faulty goods. | You benefit from the legal guarantee of conformity of at least two years. If goods do not conform, you are entitled to repair or replacement free of charge and, where appropriate, a price reduction or to end the contract for a refund. |
B8.Availability and events outside our control
Occasionally high demand means an item sells out after you have ordered, and sometimes events outside our reasonable control (such as supply failures, strikes, severe weather or carrier delays) affect our ability to supply. We are not responsible for such events, but we will contact you as soon as possible. If we cannot fulfil your order we will refund you in full; if there is a significant delay you may cancel the affected order for a refund.
B9.Our responsibility for loss or damage
We are responsible for foreseeable loss or damage we cause by breaking the contract or failing to use reasonable care and skill. We do not exclude or limit liability where it would be unlawful, including for death or personal injury caused by our negligence, for fraud, and for your statutory consumer rights (and, in the EU, for intent or gross negligence and under mandatory product liability law). We are not liable for business losses, as we supply goods for private use. Mandatory provisions of the law of your country of residence continue to apply.
B10.Fraud prevention, your data and the artist
We carry out fraud checks; orders with false information, or using freight-forwarding or reshipping addresses, may be cancelled. We handle your data under our Privacy Policy, and we will only send marketing, and only share your data with the artist and Artist Parties, where you have opted in; you can withdraw consent at any time.
B11.Promotions, product safety and accessibility
Promotions and competitions may have their own rules, which apply in addition to these terms; where stated, no purchase is necessary to enter. We comply with the General Product Safety Regulation; our EU responsible person / economic operator is BSI Merch GmbH, Gottlieb-Dunkel-Str. 20/21, Bereich Blau, Haus 1, 12099, Berlin. We are committed to an accessible store in line with the European Accessibility Act; please contact us if you need help.
B12.Changes and general
We may change these terms; the version in force when you order governs that order, and changes apply to future orders only. We may assign our rights to a group company or buyer of the business without affecting your rights; you may not assign without our consent. If any part is unenforceable, the rest continues; a delay in enforcing is not a waiver.
B13.Governing law and jurisdiction
| United Kingdom | European Union / EEA |
|---|---|
| Governed by English law. You can bring proceedings in the English courts; if you live elsewhere in the UK you may also use your local courts. As a consumer you keep the benefit of mandatory protections of the country where you live. | Governed by German law. This does not deprive you of mandatory protections of the EU/EEA country where you live, and you may bring proceedings in the courts of that country. |
B14.Complaints and dispute resolution
Please contact us first at customerservices@bsimerch.com and we will try to resolve your complaint quickly.
